New York Sales Tax Rate
The New York sales tax rate is 4% at the state level. Counties and cities add their own local taxes on top of that, and the MCTD adds a 0.375% surcharge in the New York City metro area. Combined rates across the state range from 4% to 8.875% depending on where your customer is located.
The highest combined rate in the state belongs to New York City, where the breakdown looks like this: 4% state + 4.5% city + 0.375% MCTD = 8.875%.

Do You Need to Collect New York Sales Tax?
You need to collect NYS sales tax if you have nexus in the state. There are two types:
Physical Nexus
You have physical nexus in New York if you have:
- A physical office, warehouse, or store in New York
- Employees working in New York
- Inventory stored in New York (including Amazon FBA warehouses)
- Sales reps or contractors operating in New York
New York is home to several Amazon fulfillment centers. If Amazon stores your FBA inventory in a New York warehouse, you have physical nexus in the state regardless of your sales volume.
Economic Nexus
Since June 21, 2018, New York has enforced economic nexus rules. You have economic nexus if, in the previous four quarterly periods, you met both of these thresholds:
- More than $500,000 in gross receipts from sales to New York customers, AND
- More than 100 transactions delivered to New York customers
Important: New York requires you to meet both the revenue and transaction thresholds. This is different from most states, which trigger economic nexus when you exceed either threshold. If you have $600,000 in New York sales but only 80 transactions, you do not have economic nexus in New York (though you should still monitor your numbers closely).
If you sell on Shopify and your New York sales meet both thresholds, you're required to register, collect, and remit New York sales tax.
What's Taxable in New York?
Taxable:
- Most tangible personal property (electronics, furniture, household goods, etc.)
- Prepared food and beverages
- Some digital products and software
- Utilities (gas, electricity, telephone)
- Certain services (parking, interior decorating, protective services)
Exempt:
- Most groceries (unprepared food items)
- Prescription medications
- Most clothing and footwear under $110 per item (at the state level - see note below)
- Newspapers and periodicals
- Residential energy sources (partially exempt)
New York's Clothing Exemption - What Shopify Sellers Need to Know
New York has one of the most notable clothing exemptions in the country, but it comes with a catch that trips up a lot of sellers.
At the state level, clothing and footwear items priced under $110 per item are exempt from the 4% state sales tax. This includes everyday items like t-shirts, jeans, sneakers, and jackets.
In New York City, those same items are still taxable at the local NYC rate of 4.5% plus the 0.375% MCTD surcharge. So a $90 pair of shoes shipped to a customer in Manhattan is exempt from the 4% state tax but still subject to 4.875% in local NYC taxes.
Outside of NYC, most counties also exempt clothing under $110 from their local tax. So a customer in Buffalo buying that same $90 pair of shoes would pay no sales tax at all.
Clothing and footwear items priced at $110 or more per item are fully taxable everywhere in New York at the full combined rate.
If you sell clothing or footwear on Shopify, make sure your tax settings account for this exemption. Shopify Tax handles the state-level exemption automatically, but it's worth verifying that your product tax categories are set correctly.
Shipping Charges
Shipping charges in New York are taxable when you're shipping taxable items. If the items being shipped are exempt, the shipping charge is also exempt. If you ship a mix of taxable and exempt items in the same order, you'll need to allocate the shipping charge proportionally.
How to Register for a New York Sales Tax Permit
Before collecting sales tax, you must register for a Certificate of Authority with the New York State Department of Taxation and Finance:
- Go to the New York State Department of Taxation and Finance website
- Complete the New York State Online Permit Assistance and Licensing (OPAL) application, or submit Form DTF-17 (Application to Register for a Sales Tax Certificate of Authority)
- You can register online through the NY DTF Online Services portal
- Registration is free - no fee required
- Once approved, you'll receive your Certificate of Authority
Do not collect sales tax before you receive your Certificate of Authority. New York requires that you have the certificate in hand before charging tax. You must apply at least 20 days before you start collecting.
Keep your Certificate of Authority accessible - you'll need your sales tax ID number when filing returns.
How to File New York Sales Tax Returns
New York sales tax returns are filed through the NY DTF Online Services portal at tax.ny.gov.
Filing Frequency
The New York State Department of Taxation and Finance assigns your filing frequency based on your tax liability:

Monthly filers submit returns by the 20th of the following month. Annual filers submit by March 20 for the prior year.
Note that New York uses non-standard quarter periods that don't align with traditional calendar quarters. Each quarter starts on December 1, March 1, June 1, and September 1.

Collection Allowance
New York does not offer a collection allowance or vendor credit. The state eliminated its vendor credit, so you won't receive any compensation for collecting and remitting sales tax.
Setting Up Shopify Tax for New York
If you use Shopify, enable automatic tax calculation for New York:
- In Shopify admin, go to Settings - Taxes and duties
- Under Countries/regions, find United States
- Click Manage and ensure New York is checked

Shopify Tax handles the rate lookup and the clothing exemption for items under $110, but make sure your products are assigned the correct tax categories. If you sell clothing or footwear, verify that those products are tagged properly so the exemption applies at checkout.
Shopify handles rate calculation, but you're still responsible for filing and remitting the collected tax to New York.
