Texas charges a 6.25% state sales tax on most tangible goods sold to customers in the state. With no state income tax, sales tax is the primary source of revenue for Texas, which means enforcement is taken seriously. If you sell on Shopify and have customers in Texas, you need to understand when you're required to collect, what the current rates are, and how to file your returns.

This guide covers everything Shopify sellers need to know about Texas sales tax - from registration to filing.

Texas Sales Tax Rate

The state sales tax rate in Texas is 6.25%. Cities, counties, transit authorities, and special purpose districts can add up to 2% in local taxes, bringing the maximum combined rate to 8.25%.

In practice, most major Texas cities hit that 8.25% cap. Here are some examples:

City Combined Rate Local Tax
Houston 8.25% 2.0%
Dallas 8.25% 2.0%
San Antonio 8.25% 2.0%
Austin 8.25% 2.0%
Fort Worth 8.25% 2.0%
El Paso 8.25% 2.0%

Because most urban areas stack city, transit, and special purpose district taxes to reach the 2% local cap, you'll see 8.25% across the majority of your Texas orders. Rural areas with fewer local taxing entities may have lower combined rates.

Do You Need to Collect Texas Sales Tax?

You need to collect Texas sales tax if you have nexus in the state. There are two types:

Physical Nexus

You have physical nexus in Texas if you have:

  • A physical office, warehouse, or store in Texas
  • Employees working in Texas
  • Inventory stored in Texas (including Amazon FBA warehouses)
  • Sales reps or contractors operating in Texas

Economic Nexus

Since October 1, 2019, Texas has enforced economic nexus rules. You have economic nexus if, in the preceding 12 months, you made:

  • More than $500,000 in sales to Texas customers

There is no transaction count threshold - it's based solely on sales revenue. The $500,000 threshold is higher than many other states, but given the size of the Texas market, many Shopify sellers reach it.

If you sell on Shopify and your Texas sales exceeded $500,000 in the past 12 months, you're required to register, collect, and remit Texas sales tax.

Amazon FBA and Texas Nexus

Texas is home to major Amazon fulfillment centers in the Dallas-Fort Worth, Houston, and San Antonio metro areas. If Amazon stores your inventory in any Texas fulfillment center, you have physical nexus in Texas regardless of your sales volume. You're required to register and collect Texas sales tax even if you've never set foot in the state.

What's Taxable in Texas?

Taxable:

  • Most tangible personal property (electronics, furniture, household goods, etc.)
  • Clothing and footwear (Texas does not exempt clothing)
  • Prepared food and beverages
  • Over-the-counter medications
  • Digital goods including software, digital music, and e-books

Exempt:

  • Most grocery food items (unprepared food for home consumption)
  • Prescription medications
  • Baby items including diapers, bottles, and wipes (as of recent exemptions)
  • Over-the-counter drugs sold with a prescription
  • Agricultural supplies used in farming and ranching

Shipping and Handling

Texas exempts delivery charges from sales tax when they are separately stated on the invoice. If you bundle shipping into the product price without listing it as a separate line item, the entire amount becomes taxable. On Shopify, shipping is typically shown as a separate charge, which means it should not be taxed in most cases. Make sure your Shopify invoices clearly break out shipping charges.

How to Register for a Texas Sales Tax Permit

Before collecting sales tax, you must register for a Texas Sales Tax Permit through the Texas Comptroller of Public Accounts:

  1. Go to the Texas Comptroller website
  2. Navigate to the Sales Tax Permit Application section
  3. Complete the online application through the Comptroller's portal
  4. Registration is free - there is no fee to obtain a permit
  5. Once approved, you'll receive your Texas Sales Tax Permit and 11-digit taxpayer number

You cannot legally collect Texas sales tax without a valid permit. Collecting without a permit can result in penalties.

How to File Texas Sales Tax Returns

Texas sales tax returns are filed through the Webfile portal at comptroller.texas.gov.

Filing Frequency

Your filing frequency is assigned by the Texas Comptroller based on the amount of state tax you owe:

Quarterly Tax Liability Filing Frequency
Over $1,500 per quarter Monthly
$500 - $1,500 per quarter Quarterly
Under $500 per quarter Annually

Most active Shopify sellers with significant Texas sales file monthly or quarterly.

Filing Deadlines

  • Monthly filers: Due on the 20th of the following month
  • Quarterly filers: Due on the 20th of the month following the quarter end (April 20, July 20, October 20, January 20)
  • Annual filers: Due January 20 for the prior year

If the 20th falls on a weekend or holiday, the deadline moves to the next business day.

Filing Steps

  1. Log in to Webfile at the Texas Comptroller website
  2. Select your sales tax account
  3. Enter your total sales, exempt sales, and taxable sales
  4. Report local tax amounts broken down by location code
  5. Calculate the total tax due
  6. Submit payment electronically through Webfile

Collection Allowance

Texas does not offer a timely filing discount or collection allowance. Some states compensate sellers for the cost of collecting tax, but Texas eliminated this benefit. You remit 100% of the tax collected.

Sourcing Rules

Texas uses origin-based sourcing for sellers located within the state. If your business is based in Texas, you charge the sales tax rate at your business location for all in-state sales.

For out-of-state sellers (remote sellers with economic nexus), Texas uses destination-based sourcing. You charge the rate at your customer's delivery address. This is an important distinction for Shopify sellers - if your business is physically in Texas, the rate is based on where you are. If you're outside Texas selling into the state, the rate is based on where your customer is.

Setting Up Shopify Tax for Texas

If you use Shopify, enable automatic tax calculation:

  1. In Shopify admin, go to Settings - Taxes and duties
  2. Under Countries/regions, find United States
  3. Click Manage and ensure Texas is checked
  4. Shopify Tax will automatically calculate the correct rate based on your customer's address, including local taxes
  5. Verify that shipping charges are set up as a separate line item so they remain exempt

Shopify Tax handles the rate lookup and applies the correct combined rate (state plus local) at checkout. However, you're still responsible for filing and remitting the collected tax to the Texas Comptroller.

If your business is located in Texas, review Shopify's origin-based sourcing settings to make sure in-state orders are charged at your location's rate rather than the customer's.

Using BreezyFile to File Your Texas Returns

Filing Texas sales tax returns manually through Webfile means looking up location codes, breaking down local taxes by jurisdiction, and entering everything yourself. If you sell into multiple Texas cities, that gets tedious fast.

BreezyFile automates the entire process:

  1. BreezyFile connects to your Shopify store and pulls your Texas sales data
  2. It calculates your tax liability broken down by local jurisdiction and location code
  3. It handles the local rate calculations across every Texas taxing district
  4. It files your return through the Webfile portal on your behalf
  5. You review and approve before anything is submitted

This saves you from manually looking up location codes, entering jurisdiction-level breakdowns, and reconciling local taxes across dozens of Texas cities and counties. Learn more about how BreezyFile works.

Frequently Asked Questions

Is clothing taxable in Texas?

Yes. Unlike some states that exempt clothing, Texas charges sales tax on all clothing and footwear at the standard rate. There are occasional tax-free weekends (typically in August for back-to-school shopping) where certain clothing items are temporarily exempt, but outside of those designated periods, all clothing is taxable.

Does Texas tax shipping charges?

Shipping is exempt when it is separately stated on the invoice. If you combine shipping into the product price without breaking it out as a separate line item, the full amount is taxable. Shopify typically displays shipping as a separate charge, so most Shopify sellers will not need to collect tax on shipping in Texas.

What is the difference between origin-based and destination-based sourcing in Texas?

If your business is physically located in Texas, you use origin-based sourcing - meaning you charge the tax rate at your business address for all in-state sales. If you are an out-of-state seller with economic nexus in Texas, you use destination-based sourcing - meaning you charge the rate at the customer's shipping address. This distinction affects which local tax rates apply to your transactions.

How does Amazon FBA affect my Texas sales tax obligations?

Texas has major Amazon fulfillment centers in the Dallas-Fort Worth, Houston, and San Antonio areas. If Amazon stores any of your inventory in a Texas warehouse, you have physical nexus in Texas and must register, collect, and remit sales tax - regardless of your total sales volume into the state.

What are the penalties for not filing or paying Texas sales tax on time?

The Texas Comptroller assesses a 5% penalty if your payment is 1-30 days late, and a 10% penalty if it's more than 30 days late. Interest accrues on unpaid tax at a rate set by the Comptroller. If you collected sales tax from customers but failed to remit it, that can result in additional penalties and potential criminal liability.

Do I need to file a Texas sales tax return even if I had no sales?

Yes. If you hold an active Texas Sales Tax Permit, you must file a return for every reporting period even if you had zero sales and zero tax to report. Filing a zero return keeps your account in good standing and avoids late filing penalties.
